Reason: In the interest of the proper planning and sustainable development of the area. ### Condition 16 To ensure full implementation of the proposed landscape design, the developer is required to retain the services of a Landscape Consultant throughout the life of the site development works. A completion certificate is to be signed off by the Landscape Consultant when all works are completed and in line with the submitted landscape drawings for the written agreement of the Planning Authority. Reason: In the interest of the proper planning and sustainable development of the area. ### Condition 17 In line with the national children's play policy 'Ready Steady Play', provision is to be made to include suitable play opportunities for the future child population for all ages, within the proposed development. Although play opportunities have been included in the proposal, there is a need for additional play facilities for the young children or toddlers for the residential part of the development. The revised boundary treatments shall provide a solid masonry wall. The height of the wall shall be such so as to ensure that noise levels within the development are within acceptable levels before and after the future road improvements, and shall be to the satisfaction of the Planning Authority. Reason: In the interest of the residential amenity of future occupiers of the development. ### Condition 21 The demolition material shall be reused / recycled insofar as possible within the site of the proposed development. Demolition materials, which cannot be reused /recycled within the proposed development shall be disposed of in a sustainable manner. REASON: In the interest of sustainable development. ### Condition 22 The proposed development is located adjacent to and potentially encroaches upon a section of open channel in the Carrickmines (Glenamuck) / Loughlinstown system, a regionally important salmonid system. The Carrickmines system supports a resident population of Brown Trout an a migratory population of sea trout (both Salmo trutta). Thus, it is vital to note that salmonid waters constraints apply to any development in this area. The presence of these fish populations highlights the sensitivity of local watercourses and the Carrrickmines catchment in general. Fishery habitat is regarded as good for all salmonid life stages throughout much of the system. In this regard: a. Only clean, uncontaminated water should levae the development site and drain to the river network. b. The Board's policy is to maintain watercourses in their open natural state in order to prevent habitat loss, preserve biological diversity and aid in pollution detection. Any river or stream manipulation works (bridging, culverting or otherwise) must first be submitted to the Board for consulation and approval. The Board generally recommends retention of natural riparian vegetation features with minimal disturbance and manipulation of river banks. c. Should development proceed, best practice should be implemented at all times in relation to any activities that may impact on surface water (stream and river) or riparian habitats. Any discharges to surface streams present on the site must not impact negatively on the salmonid status of the system. Comprehensive surface water management measures (GDSDS study recommendations) must be implemented at the construction and operational stage to prevent any pollution of local surface waters. Class I petrol/oil interception (and possibly hydrobrake controls) should be in place on primary surface water discharges to protect receiving freshwaters in terms of water quality (and possibly quantity if flooding is an issue, although beyond the remit of this authority). Precautions must be taken to ensure there is no entry of solids, during the connection of pipe-work, to the existing surface water system. d. It is recommended that the "Requirements for the Protection of Fisheries Habitat during Construction and Development Works at River Sites" http://www.fishingireland.net/environment/constructionanddevelopment.htm be consulted when planning to undertake works on this site. The maintenance of habitat integrity (both in-stream and riparian) is essential in safeguarding the ecological value of this important urban natural resource. The specific details of any works directly affecting watercourses or riparian habitats in the area, in particular surface water discharges to streams must first be submitted to the Board for assessment. Reason: In order to protect and safeguard the salmonid character of the adjoining watercourse. ### Condition 23 Archaeological monitoring shall consist of the following: a. The applicant shall employ a qualified archaeologist to monitor all groundworks associated with the development. The development works, including archaeological monitoring, can only proceed following the granting of Ministerial Consent, as required under Section 14 of the National Monuments (Amendment) Act 2004. b. Should archaeological material be found during the course of monitoring the archaeologist may have work on site stopped, pending a decision as to how best to deal with the archaeology. The developer shall be prepared to be advised by the Department of the Environment, Heritage and Local Government with regard to any necessary mitigating action (e.g preservation in situ, or excavation) and should facilitate the archaeologist in recording any material found. c. The Planning Authority and the Department of the Environment, Heritage and Local Government shall be furnished with a report describing the results of the monitoring. Reason: To ensure the continued preservation (either in site or by record) of places, caves, sites, features or other objects of archaeological interest. ### Condition 24 Prior to commencement of development the Applicant shall submit drawings for the agreement of the Planning Authority detailing the elevation of the proposed boundary treatment at: (a) Alongside motorway and Council owned lands and (b) Along the Glenamuck Road frontage. In respect of (a) this shall include any revisions required to meet noise mitigation/amelioration measures referred to elsewhere in these conditions and shall include foundation details demonstrating they do not intrude on Council or motorway lands. In respect of (b) the boundary treatment shall be set back to the line of the future widening of Glenamuck Road that shall be marked out and agreed on site with the Planning Authority. A dwarf corral type treated timber open post and rail fence or similar treatment shall be provided alongside the back of the footpath of Glenamuck Road to details to be agreed with the Planning Authority prior to commencement of and in order to define the area in ownership of the Applicant for which area he will have to continue to be responsible for the maintenance and retain public liability responsibility until such land transfers to the Council for the future road widening scheme either by Agreement, CPO or other means. Reason: In the interest of the proper planning and sustainable development of the area. ### Condition 25 The developer shall, prior to commencement or as otherwise agreed in writing with the Planning Authority, to pay the Planning Authority the sum of €120,000.00 in respect of a combined pedestrian and cycle link to the dual carriageway section of Glenamuck Road at the entrance to the park, Carrickmines across Council property to the north of the site linking to that proposed within the lands of the Applicant as a special financial contribution under Section 48 (2)(c), with any outstanding balance being updated at the 1st of January each year during the life of the scheme in accordance with annual changes in the Wholesale Price Index - Building and Construction (Capital Goods) published by the Central Statistics Office, to the Planninbg Authority. This combined pedestrian and cycle link will benefit the development of the Applicant's land in two ways: a. It will provide a link for slow modes of travel (pedestrians and cyclists) to the nearest LUAS Line B1 Station of Ballyogan Wood and significantly reducing the distance of travel to and from that station for such modes and which is consistent with the proposed density of units on the site relative to the modal shift to such modes of travel etc,. b. It will provide a route for emergency vehicles to access the site and Glenamuck Rd cul de sac until the future link to Cherrywood is in place, which could otherwise become a singular access cul-de-sac of approximately 400 houses that is unacceptable on emergency grounds without such an emergency access. Should the final cost of the construction costs be less that the section 48 2 (c) contributions then the Applicant will be refunded accordingly. The Applicant shall not occupy the development until this link is put in place. Reason: In the interest of the proposed planning and sustainable development of the area. REASON: It is considered reasonable that the payment of a special contribution be required in respect of a combined pedestrian and cycle link to the dual carriageway section of Glenamuck Road at the entrance to the Park, Carrickmines across Council property to the north of the site linking to that proposed within the lands of the Applicant. ### Condition 4 The proposed development shall not be occupied until the commissioning of the Sandyford High Level Water Supply Level Scheme. REASON: In the interest of public health. ### Condition 26 The Applicant has indicated that there is to be one car space/Part V unit. Whilst this provision meets with the Council's Part V payment arrangement that arrangement does not limit/restrict the provision of car parking spaces for such Part V units which should be consistent with the development as a whole that in effect provides for 1space/1 bedroom unit, 1.5 spaces per 2 bedroom unit and 2 spaces for 3 bedroom units or greater size. It is important that there is no discriminatory allocation of car parking between Part V and other units i.e. there shall be equal allocation. The Applicant shall agree such allocation with the Planning Authority prior to commencement of development. Reason: In the interest of the proper planning and sustainable development of the area. ### Condition 27 Prior to commencement of development the Applicant shall agree with the Planning Authority details of any adjustments required to the lighting on Glenamuck Road to accommodate the new access for this development. Reason: In the interest of the proper planning and sustainable development of the area. ### Condition 28 On completion of the development the Applicant shall at his expense undertake an independent accessibility audit of the roads, footpath and landscaped areas etc with the Independent Auditor approved by the Planning Authority. All measures identified by the audit shall be undertaken unless the Planning Authority permits an exception in writing. Reason: In the interest of the proper planning and sustainable development of the area. ### Condition 29 The Applicant shall provide facilities within the car pak of the development for owners of electrically powered cars to be able to recharge their cars. Details shall be submitted to and agreed with by the Planning Authority prior to commencement of development. Reason: In the interest of the proper planning and sustainable development of the area. ### Condition 30 With regard to Noise Assessment and mitigation/amelioration measures the Applicant shall demonstrate to the satisfaction of the Planning Authority prior to commencement of development what measures would be required to meet with the requirements of the NRA limit of 60dB Lden and shall agree with the Planning authority what additional measures over and above those proposed by the Applicant, if any, need to be implemented . Whilst the Applicant refers to certain codicils regarding the application of the NRA Guidelines the Applicant has not taken into account that there are possible proposals to upgrade the adjoining M50 including providing an additional lane in each direction as well as upgrading the southbound exit ramp and providing a by-pass of the roundabout at the top of this exit ramp all of which where shown on the Applicants drawings in his response to the Clarification of Additional Information request. Should the development proceed in advance of these upgrade works then the residential units will be in place prior to the road upgrade works and hence makes the NRA criteria applicable. Meeting these NRA requirements will in turn meet the Transport UK Department of the Environment Planning Policy Guidance 24 document on the issue of traffic noise. Reason: In the interest of the proper planning and sustainable development of the area. ### Condition 31 The Applicant shall provide a Construction Management Plan to indicate measures to avoid, reduce or mitigate nuisance due to noise, dust or dirt including road/gulley cleaning measures. Reason: In the interest of the proper planning and sustainable development of the area. ### Condition 5 That the water supply and drainage arrangements, including the disposal of surface water, be in accordance with the requirements of the County Council. In this regard: a. Construction details of the 200mm water main shall be submitted to the Planning Authority for approval prior to construction. The 200mm water main shall at least continue as far as indicated in Drawing 072-190-006 Rev P0. b. The Applicant shall submit suitable water storage calculations for both domestic and non domestic consumption with respect to each unit. This should include landscape needs and any non domestic use in the domestic blocks. Expected peak flows shall also be included. Note: Water saving devices e.g. controlled/timed flushing of urinals shall be incorporated in the design of the plumbing system. c. Storage for domestic and non domestic shall be separate as far as possible (for metering purposes). d. Further detail with regard to how it is proposed to supply Block E and F, the crèche and the spa facility respectively with water, shall be submitted to the Planning Authority. e. A minimum of 300 mm shall be maintained between water services and other services. f. Dead ends shall have an approved valve arrangement and closed looped layout where possible. g. The applicant shall have due regard to the Fire Department requirements and that of the County Council regarding the provision of water circulation to maintain water quality, and mains flushing facilities. The applicant should consider a ring main around Block E. h. The design and installation of water supply within the building will provide for a potable water supply to each individual unit. Details to be agreed with Building Control before works commence. i. The Local Authority shall meter all non domestic water. Note: If the applicant requires a construction supply, the applicant shall make a water connection application (for metering purposes). j. A Management Company shall be established to undertake the upkeep and maintenance of all common services and areas. This shall include the apportionment of all charges. In the event of a metering of domestic water services becoming operable at a future time, the proposed Management Company will enter into an appropriate Meter Agreement with the Council or its successors. k. The applicant shall submit details of the proposed manufacturer / supplier of all watermains and fittings. l. The foul sewer along Glenamuck Road is to be laid at a sufficient depth to allow adjoining developments access. m. A grease trap shall be installed at a suitable location in the private drainage system. The grease trap shall comply with the latest draft of prEN 1825 - Part I (Principles of Design, Performance, Testing, Marking and Quality Control) and prEN 1825 - Part II (Selection of Nominal Size, Installation, Operation and Maintenance of Grease Separators). n. The surface water drainage shall be in accordance with the recommendations of the Greater Dublin Drainage Study (GDSDS) in relation to Sustainable Drainage Systems (SuDS) and should generally meet the four criteria set out in the GDSDS documents 'Regional Drainage Policies, Technical Document, Volume Two, New Development'. o. The finished floor levels shall be at least 500mm above the highest recorded flood level in the area. REASON: In the interest of public health. ### Condition 8 An acceptable naming and numbering scheme shall be submitted for the written agreement of the Planning Authority prior to the commencement of development or the erection of any advertising hoardings on site. REASON:- In the interests of orderly development. ### Condition 9 That each apartment be used as a single dwelling unit. REASON: To prevent unauthorised development. ### Condition 11 No plant or machinery shall be installed on any roof. Reason: In the interest of residential amenity. ### Condition 12 The parking spaces for the residential units shall be sold as an integral part of the residential units, and must not be sold as separate entities. This requirement is to prevent the spaces from either being sold to non-residents or residents not availing of the separate take-up of the parking space(s), which may result in residents parking on-street or in adjacent developments so as to avoid paying for a parking spot within the development, and thereby undermining the local parking strategy REASON: In the interest of the proper planning and sustainable development of the area. ### Condition 13 Prior to commencement of development, the applicant shall enter into an agreement with Dun Laoghaire-Rathdown County Council to reserve the equivalent of 20% of the residential floorspace of the development in accordance in accordance with Section 96 of the Planning & Development Act 2000, as amended by the Planning & Development (Amendment) Act 2002 in compliance with the requirements of Part V of the Planning & Development Acts 2000-2002 and the objectives of the Housing Strategy subject to agreement being reached on the land valuations and development costs.
