Appropriate Assessment (AA) Screening As per the Biodiversity Officer's report dated 04.05.22, it states that 'the Screening for Appropriate Assessment Report has been reviewed and is considered, in the opinion of the Biodiversity Officer, that it provides sufficient information in support of the conclusion of no significant effects.' Having regard to the Biodiversity Officer's report, the nature and scale of the proposed development, as clarified by way of Further Information received on 08.04.22, it has been determined that the development would not significantly impact upon a Natura 2000 Site. Environmental Impact Assessment (EIA) Screening As per the response to Further Information item No.1, the red line boundary of the subject application now includes the full application site for DZ20A/0399 which comprises the development area, access roadways to this site from public roads, i.e. parts of Castle Street, Bishop's Lane, the link road from the Wyattville Link road, a part of Cherrywood Avenue, roads permitted under DZ20A/0399, the permitted temporary pond, the area comprising the sewer routes and permanent attenuation tanks, the development area for 47 no. units, part of the green infrastructure zoned site at the future Tully Village Centre to accommodate a temporary construction compound and parking area. It is noted that Further Information response resulted in the increase in the site area to approx.9.5ha. The Planning Authority note the roads infrastructure which forms part of this subject application equates to approx.4.1ha of the overall subject application as stated under DZ20A/0399. While it is noted that the Applicant has not submitted information for the purposes of screening sub-threshold development for environmental impact assessment, the Planning Authority has regard to Class 13 Part 2 Schedule 5 of the Planning and Development Regulations 2001 [as amended], in particular 13(a)(ii) which relates to, 'Any change or extension of development already authorised, executed or in the process of being executed (not being a change or extension referred to in Part 1) which would: (ii) result in an increase in size greater than - - 25 per cent, or - an amount equal to 50 per cent of the appropriate threshold, whichever is the greater.' It is noted that the subject application is seeking permission for an additional 47 units and associated facilitatory immediate surrounding area on a site measuring approx. 0.3ha to the previously permitted development DZ20A/0399, thus totalling an overall residential quantum of 3.3ha within a site area of 9.5ha. The Planning Authority consider the subject size of the proposed development, namely 0.3ha, to result in an increase less than 25 percent of 9.5ha. Having regard to the nature and scale of the proposed development, as clarified by way of Further Information received on 08.04.22, it is considered that no real likelihood of significant effects on the environment would arise from the proposed development. Second Schedule Conditions 1. The development shall be carried out in its entirety in accordance with the plans, particulars and specifications lodged with the application, as amended by Further Information received on 08.04.22, save as may be required by the other conditions attached hereto. and further then, save for amendments granted on foot of this permission, the development shall otherwise be carried out in strict accordance with the terms and conditions of Planning Permission Reg.
