Reasons and Considerations
Having regard to the land use zoning of the site as set out in the Cherrywood Planning Scheme, as amended, and the 2022-2028 Dún Laoghaire - Rathdown County Development Plan, it is considered that subject to compliance with the conditions below, the proposed development would not seriously injure the amenities of the area and would not contravene materially the zoning of the application site or that of adjoining sites, subject to conditions.

Appropriate Assessment (AA) Screening
Having regard to the nature and scale of the proposed development, as clarified by way of Significant Further Information received on 11.10.2023, it has been determined that the proposed development would not significantly impact upon a Natura 2000 Site.

Second Schedule
Conditions

1. (a)The development shall be carried out in its entirety in accordance with the plans, particulars and specifications lodged with the application, as amended by Further Information received on 11.10.2023, save as may be required by the other conditions attached hereto.  Save for amendments granted on foot of this permission - i.e. the replacing of condition 5 of the 'parent' permission with condition 2 below - the development shall otherwise be carried out in strict accordance with the terms and conditions of Planning Permission Reg. Ref. DZ21A/1085, save as may be required by the other conditions attached hereto.
(b) No other development or amendments are permitted on foot of this planning permission.
REASON: To ensure that the development shall be in accordance with the permission and that effective control be maintained.

2. The Applicant/Developer shall comply with the following requirements. In the interests of clarity, this condition effectively replaces Condition 5 of the 'parent' permission under DZ21A/108.
(a) The Cherrywood Avenue and Beckett Road Underpass H-G-F-F1 road network as previously granted under DZ21A/1017, shall have commenced construction prior to the occupation of the final phase of residential development (Phase 4 - 8 no. 3 bed units) as outlined under this application (DZ23A/0443) and permitted under DZ21A/1085. Prior to the occupation of any residential units within Phase 4, the Applicant / Developer shall submit for the written agreement of the Planning Authority, evidence that the full extent of the above road network has progressed / is progressing on site.
(b) The entirety of Gun and Drum Hill shall have been completed to a taken in charge standard and in accordance with the road network permitted DZ15A/0758 and DZ15A/0758/E, prior to the occupation of any development permitted under DZ21A/1085.
REASON: In the interests of orderly development, proper planning and the sustainable development  and to ensure that the Cherrywood road network for Development Area 7 is provided in tandem with residential development having regard to the Phasing and Sequencing requirements of the Cherrywood Planning Scheme as set out under Section 7.2, Table 7.3 and Section 7.2.2 as the access requirements of the Cherrywood Planning Scheme as set out under Map 6.7, Table 6.7.2 and PI 18.

NOTE 1: The proposed development shall accord with the requirements of Irish Water.

NOTE 2: The attention of the applicant is drawn to Section 34(13) of the Planning and Development Act 2000, as amended, which relates as follows- 'A person shall not be entitled solely by reason of a permission under this section to carry out any development'.
