Appropriate Assessment (AA) Screening Dún Laoghaire-Rathdown County Council, as the competent authority, is required to undertake screening for Appropriate Assessment. Having regard to the nature, scale and location of the proposed development, as clarified by way of Further Information received on 26/06/2026 and further clarified by way of Clarification of Further Information received on 10/09/2026, the Appropriate Assessment Screening Report prepared by Minogue & Associates Environmental Consultancy submitted with the application, and the review undertaken by Fehily Timoney on behalf of the Development Agency Project Team, it was determined that the proposed development, individually or in combination with other plans or projects, would not be likely to have a significant effect on any Natura 2000 site. Further regard has been had to the updated ecological and hydrological information submitted by way of Further Information, including the updated Ecological Impact Assessment and Responses to RFI: Biodiversity Items report prepared by Minogue & Associates Ecological Consultants, together with the updated Water Framework Directive Assessment prepared by AWN Consulting. A further report prepared by Fehily Timoney on behalf of the Development Agency Project Team, received on 07/07/2026, concludes that, based on the information submitted by way of Further Information, the proposed development is consistent with the Cherrywood Planning Scheme in relation to its Biodiversity Plan and the environmental parameters established under the Strategic Environmental Assessment, subject to conditions. Further regard has also been had to the information and revised proposals submitted by way of Clarification of Further Information, including the revised surface water drainage strategy. The DAPT CFI Report notes that no further report was requested from or prepared by Fehily Timoney at Clarification of Further Information stage and concludes that, in the context of the Clarification of Further Information response, the proposed development remains consistent with the Cherrywood Planning Scheme. Having carried out AA Screening, and having regard to the original AA Screening Report, the DAPT environmental review, the further ecological and hydrological information submitted by way of Further Information, and the information and revised proposals submitted by way of Clarification of Further Information, it is considered that the proposed development, individually or in combination with other plans or projects, would not be likely to have a significant effect on any Natura 2000 site. Accordingly, a Stage 2 Appropriate Assessment is not required. Environmental Impact Assessment (EIA) Screening It is the responsibility of the competent authority, Dún Laoghaire-Rathdown County Council, to undertake screening for Environmental Impact Assessment (EIA). Having regard to the nature and scale of the proposed development, as clarified by way of Further Information received on 26/06/2026 and further clarified by way of Clarification of Further Information received on 10/09/2026, comprising a residential scheme of 343 no. apartments, together with a mobility hub, residential amenity space, car and cycle parking, internal roads and footpaths, public open space, communal amenity space, landscaping, drainage and SuDS infrastructure, revised temporary bus turning arrangements, decommissioning of the temporary attenuation pond, and all associated site development works, and having regard to the EIA Screening Report prepared by Trinity / AWN Consulting and reviewed by Fehily Timoney on behalf of the Development Agency Project Team, it is considered that there is no real likelihood of significant effects on the environment arising from the proposed development. Further regard has been had to the information and revised proposals submitted by way of Clarification of Further Information, including the revised surface water drainage strategy and associated landscape amendments. The DAPT CFI Report notes that no further report was requested from or prepared by Fehily Timoney at Clarification of Further Information stage and concludes that the proposed development remains consistent with the Cherrywood Planning Scheme. The proposed development comprises 343 no. dwellings and is below the applicable 500-dwelling threshold under Class 10(b)(i) of Part 2 of Schedule 5 to the Planning and Development Regulations 2001, as amended. Having regard also to the nature, scale and location of the development, the submitted EIA Screening Report, the environmental information submitted at application and Further Information stages, and the nature of the amendments submitted at Clarification of Further Information stage, it is considered that there is no real likelihood of significant effects on the environment. Accordingly, an EIAR is not required. Water Framework Directive The nearest surface water receptor is the Ticknick / Carrickmines Stream, which runs through the western part of the site. A Water Framework Directive Assessment, prepared by Trinity / AWN Consulting, was submitted with the original application and was reviewed by Fehily Timoney on behalf of the Development Agency Project Team. The Planning Authority notes the submission received from Inland Fisheries Ireland dated 12 May 2026, which raised concerns regarding potential construction and operational phase impacts on the Carrickmines / Ticknock Stream. This matter formed part of the Request for Further Information, specifically FI Item 16, which sought evidence of consultation with Inland Fisheries Ireland, details of the proposed pedestrian bridge over the stream, and an updated Water Framework Directive Assessment. By way of Further Information received on 26/06/2026, the Applicant submitted an updated Water Framework Directive Assessment, together with biodiversity responses and an updated Ecological Impact Assessment prepared by Minogue & Associates Ecological Consultants. The DAPT FI Report notes that the submitted information adequately addresses FI Item 16(a) and 16(b), subject to a condition requiring the final bridge design and construction methodology to be agreed with Inland Fisheries Ireland prior to commencement of development. A further report prepared by Fehily Timoney on behalf of the Development Agency Project Team, received on 07/07/2026, concludes that, based on the response information submitted by way of Further Information, the proposed development is now consistent with the environmental parameters of the Cherrywood Planning Scheme. The adequacy of the response in the context of the Cherrywood SDZ Planning Scheme is addressed in the DAPT Further Information Report and in the assessment of the response to Further Information Request Item 16. Further regard has been had to the information and revised proposals submitted by way of Clarification of Further Information received on 10/09/2026, including the revised surface water drainage strategy and additional surface water treatment measures. The DAPT CFI Report concludes that, in the context of the Clarification of Further Information response, the proposed development remains consistent with the Cherrywood Planning Scheme from the perspective of its Biodiversity Plan and the environmental parameters established under the Strategic Environmental Assessment, subject to conditions. Having regard to the original and updated Water Framework Directive Assessments, the ecological and hydrological information submitted by way of Further Information, and the revised surface water drainage strategy and additional treatment measures submitted by way of Clarification of Further Information, it is considered that the proposed development would not result in deterioration in the status of the relevant waterbody or prevent the achievement of the applicable Water Framework Directive objectives.
